1. Acceptance of Terms

By accessing or using the services, website, or communications of Kintech Heating & Cooling ("Company," "we," "us," "our"), you ("Customer," "you," "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services

Kintech Heating & Cooling provides residential and commercial HVAC services across Long Island, NY. Services include but not limited to installation, repair, maintenance, and inspection of heating, ventilation, and air conditioning systems.

Service availability is subject to scheduling and technician availability. All estimates and quotes are based on information available at the time and are valid for 30 days from the date issued, unless there is a significant change in equipment or material pricing. Final pricing may be adjusted based on on-site inspection and actual conditions encountered. Any changes to quoted pricing will be communicated to you before work proceeds.

3. SMS/Text Messaging Terms

3.1 Consent to Receive Messages

By providing your phone number to Kintech Heating & Cooling, whether through our website, over the phone, in person, or via a service request form, you expressly consent to receive SMS/text messages from us. We send two categories of messages:

  • Service-Related Messages (Transactional): Appointment confirmations, scheduling reminders, service updates, technician arrival notifications, invoice and payment confirmations, review requests, and follow-up communications directly related to services you have requested.

  • Promotional Messages (Marketing): Seasonal offers, maintenance reminders, special discounts, and company news.

You may receive both types of messages unless you opt out as described below. Consent to receive messages is not a condition of purchasing any service from Kintech Heating & Cooling.

3.2 Message Frequency

Message frequency varies depending on your service activity and our promotional schedule. Standard message and data rates may apply. Check with your mobile carrier for details.

3.3 Opt-Out

You may opt out of SMS communications at any time by replying STOP to any message you receive from us. Upon receiving your opt-out request, we will send a single confirmation message and cease further SMS communications. You may also contact us directly to request removal from our messaging list.

Opt-out requests will be processed promptly. If you opt out and later wish to resume receiving messages, you may re-enroll by contacting us or by texting RESTART to the number from which you previously received messages.

Message and data rates may apply depending on your mobile carrier and plan. Kintech Heating & Cooling is not responsible for any charges incurred from receiving SMS messages. Delivery of messages is subject to your carrier's network availability and coverage. We do not guarantee delivery of any SMS message.

3.6 No Mobile Information Sharing

We do not sell, rent, share, or otherwise disclose your mobile phone number or SMS opt-in data to any third parties or affiliates for their marketing purposes. Your phone number and consent information are used solely by Kintech Heating & Cooling for the purposes described in these terms.

4. Privacy and Data Collection

In the course of providing services, we may collect personal information including your name, address, phone number, email address, and service history. This information is used to provide, schedule, and follow up on HVAC services, process payments, and communicate with you as described in these terms.

We do not sell your personal information to third parties. Information may be shared with trusted service providers, including SMS communication platforms, payment processors, and analytics providers, solely as necessary to deliver our services. These providers are contractually obligated to protect your data and use it only for the services they provide to us.

We may also share information with telecommunications providers as necessary to facilitate SMS communications and ensure delivery, and with regulatory authorities or other parties as required by law.

5. Payment Terms

All payments for services must be made in accordance with the agreed terms. Late payments may incur penalties or interest as permitted by law. We accept major credit cards, checks, and financing options through third-party providers where available. Financing terms and eligibility are subject to the third-party provider's terms and conditions.

6. Warranties and Guarantees

Manufacturer warranties on equipment are passed through to the Customer and are subject to the manufacturer's terms and conditions. Kintech Heating & Cooling provides a one (1) year workmanship warranty on labor performed, unless otherwise specified in your service agreement or invoice.

Warranties do not cover damage caused by misuse, neglect, unauthorized modifications, failure to maintain equipment, or pre-existing conditions not identified during the original service.

7. Limitation of Liability

To the fullest extent permitted by law, Kintech Heating & Cooling's total liability for any claim arising out of or related to our services shall not exceed the total amount paid by the Customer for the specific service giving rise to the claim.

We are not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of use, lost profits, property damage not directly caused by our work, or damages arising from pre-existing conditions of the Customer's HVAC system, property, or infrastructure.

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to severe weather, supply chain disruptions, utility outages, or acts of God.

8. Indemnification

The Customer agrees to indemnify and hold harmless Kintech Heating & Cooling, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) the Customer's misrepresentation of system conditions or property access; (b) the Customer's failure to disclose known hazards or pre-existing conditions; or (c) unauthorized modifications to work performed by Kintech Heating & Cooling.

9. Cancellation and Rescheduling

Service appointments may be canceled or rescheduled with at least 24 hours' notice. We ask that you notify us as early as possible so we can accommodate other customers.

10. Dispute Resolution

In the event of a dispute arising from these terms or our services, both parties agree to first attempt resolution through informal negotiation. The dissatisfied party shall provide written notice describing the dispute and proposed resolution. The parties shall have 30 days from receipt of such notice to resolve the matter informally. This informal resolution requirement does not apply to the enforcement of payment obligations or collections under Section 5.

If informal resolution is unsuccessful, either party may pursue remedies available under law in the courts of Suffolk County, New York.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any legal proceedings shall be brought in the courts located in Suffolk County, New York.

12. Amendments

Kintech Heating & Cooling reserves the right to update or modify these Terms and Conditions at any time. Updated terms will be effective immediately upon posting to our website. Continued use of our services after any changes constitutes acceptance of the revised terms.
